An unwed biological father can establish legal rights to the child by putting his name on the child’s birth certificate and signing an Affidavit of Parentage before the child’s 18th birthday. We can help you add your name to your child’s birth certificate. If the alleged father does not sign an Affidavit of Parentage, DNA testing will be used to prove or disprove paternity.
Either the mother or the alleged father may file a paternity action. Mothers may file a paternity suit if they wish to establish child support for the child. Child support cannot begin until paternity is legally established.
An unmarried father can file to establish his legal rights to a child. Unwed fathers must be legally recognized by the court as the child’s father before they have the right to seek child custody and visitation with the child.
Men may also file a paternity suit to disprove paternity if they have been wrongly named as the father.
